Kesha’s claims against Dr. Luke and her contract with Sony have officially been thrown out by the court. In February Kesha had attempted to appeal the decision that she could not be released from her contract, and now the appeal has been denied.
Kesha was seeking to be released from her contract on the claims that producer Dr. Luke seuxally, emotionally, and physically abused her throughout the past of their working relationship. Dr. Luke has continued to deny the claims against him, as well as coming back at the claims with a defamation suit.
However, the appeal that Kesha filed was filed in New York, and the judge presiding over the case has now said that Kesha “failed to plead that any of the alleged discrimination occurred in New York State or City,” meaning that the court had no jurisdiction over the case.
The court also denied any claims that abuse from Dr. Luke could be considered a hate crime.
“Although Gottwald’s alleged actions were directed to Kesha, who is female, (her claims) do not allege that Gottwald harbored animus toward women or was motivated by gender animus when he allegedly behaved violently toward Kesha. Every rape is not a gender-motivated hate crime.”
Additionally, they are saying that the statute of limitations on the claim have already expired as well.
Kesha’s case has been made even more complex by the fact that 2011 court documents include proceedings where Kesha denied the rape claims that she is making again now. Kesha also claimed that she was given the option to walk out of the contract if she would deny the rape claims once again.
